Attorney-at-law Hussain-Hämäläinen, LL.M. wins case against large American infrastructure company

I represent several employees in dismissal protection proceedings against the German subsidiary of a well-known American infrastructure group. On November 7th, 2024 there was a first judgment from the Wiesbaden Labor Court, Ref.: 5 Ca 512 / 23. The client I represented won his dismissal protection lawsuit! The court also awarded him a late acceptance fee amounting to a six-figure sum and a right to information under the GDPR. A great success that we are very happy about.

I am repeatedly asked by employees how promising a claim for protection against dismissal is. It depends. If the Dismissal Protection Act (Kündigungsschutzgesetz) applies, the prospects are generally good. In this case, the employer has the full burden of presenting and proving that the reasons for termination exist. Furthermore, the balancing of interests etc. must be carried out. The courts‘ standards for the employer’s presentation are very high.
